Terms and Conditions of WeevilEDC GmbH

1. Scope of Application

These Terms and Conditions apply to all orders placed via the online store operated by WeevilEDC GmbH.

They apply to consumers and businesses unless expressly stated otherwise.

3. Conclusion of Contract

The presentation of products in the online store does not constitute a legally binding offer but an invitation to place an order.

A binding contract is concluded only when we confirm your order by email (order confirmation).

4. Prices and Taxes

All prices shown in the online store:

  • include statutory value-added tax (VAT), where applicable

  • exclude shipping costs, which are displayed separately during checkout

For deliveries outside the European Union, additional customs duties, taxes, or fees may apply and must be borne by the customer.

5. Payment

Payment is made using the payment methods offered in the online store, in particular:

  • PayPal

  • Klarna

  • Stripe

Payment is due immediately upon conclusion of the contract.

6. Delivery and Shipping

Delivery is made to the shipping address provided by the customer.

Unless otherwise stated, delivery times are estimates and not binding.

If delivery delays occur due to force majeure or circumstances beyond our control, we shall not be liable for such delays.

7. Retention of Title

The goods remain the property of WeevilEDC GmbH until full payment has been received.

8. Right of Withdrawal (Consumers in the European Union)

If you are a consumer residing in the European Union, you have a statutory right of withdrawal in accordance with applicable EU consumer protection laws.

9. Voluntary Return Policy

In addition to statutory rights, we may offer a voluntary return policy.

Statutory rights, in particular the EU right of withdrawal, remain unaffected.

10. Warranty and Liability

Warranty

Statutory warranty rights apply.

Liability

We shall be liable without limitation in cases of intent or gross negligence.

In cases of slight negligence, we shall only be liable for breaches of essential contractual obligations (cardinal obligations). In such cases, liability is limited to foreseeable, typical damages.

Liability for indirect damages, consequential damages, or loss of profit is excluded to the extent permitted by law.

11. Product Use and Responsibility

Our products are designed for lawful everyday use.
The customer is responsible for ensuring that the use of the products complies with applicable local laws and regulations, especially when ordering from outside the European Union.

12. Exclusion of Liability for External Links

Our website may contain links to external third-party websites.
We have no influence over the content of these websites and assume no liability for them.

13. Governing Law and Jurisdiction

These Terms and Conditions are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers, mandatory consumer protection laws of the country of residence remain unaffected.

The place of jurisdiction shall be Vienna, Austria, where legally permissible.

14. Contract Language

The contract language is English.
A German version may be provided for informational purposes. In case of discrepancies, mandatory statutory provisions shall prevail.

15. Severability Clause

If individual provisions of these Terms and Conditions are or become invalid or unenforceable, the remaining provisions shall remain unaffected.
